Ahead (*20*) the November 20 judgment, the chief (*20*) the Indigenous Individuals (*20*) Biafra, IPOB, Nnamdi Kanu, has filed a Direct Criminal Criticism against two prosecution witnesses within the course (*20*) his trial.
Kanu, who recognized each witnesses as Mr TAA, also referred to as PW1, and Mr BBB, also referred to as PW2, claimed that “they willfully gave false proof on oath.”
The criticism, addressed to the Chief Justice of the Peace Courtroom (*20*) the FCT Excessive Courtroom, was primarily based on Sections 156, 158(1), 159(1) and 160 (*20*) the Penal Code, Part 88 (*20*) the Administration (*20*) Criminal Justice Act, 2015, and Sections 34 and 36 (*20*) the 1999 Structure (as amended).
It reads: “Mazi Nnamdi Kanu, Grownup, Male, Christian, Nigerian Citizen, (*20*) Umuahia, Abia State, and Chief (*20*) the Indigenous Individuals (*20*) Biafra, IPOB, presently detained by the Division (*20*) State Providers,DSS) since twenty ninth June 2021, do hereby solemnly affirm and complain as follows:
“That on numerous dates between Could and July 2025, on the Federal Excessive Courtroom, Abuja, in the course of the listening to and trial-within-trial within the case (*20*) Federal Republic (*20*) Nigeria v. Nnamdi Kanu (FHC/ABJ/CR/383/2015), Mr. TAA and MR. BBB, being witnesses referred to as by the prosecution in my trial, willfully gave false proof on oath, realizing identical to be false and/or not believing identical to be true and materials to the admissibility (*20*) the 2015 and 2021 statements, thereby committing perjury opposite to sections 156, 158 and 159 (*20*) the Penal Code.
“That MR. TAA, on web page 352 (*20*) the Licensed True Copy (*20*) proceedings dated twenty sixth June 2025, beneath oath, said as follows: ‘I can’t recall… I didn’t know another Mr. Brown my lord,’ when requested if he knew Mr. Brown Ekwoaba, the Assistant Director (Investigations) on the DSS Nationwide Headquarters, Abuja, who personally supervised the October–November 2015 interviews and detention (*20*) the complainant.”
The IPOB chief described the denial by TAA as false.
He added: “That MR. TAA’s denial is fake, as established by: Affidavit (*20*) Prince Emmanuel Kanu (Exhibit C), confirming six (6) visits to the complainant in Mr. Brown Ekwoaba’s workplace at Yellow Home, third Ground, between October 2015 and January 2016; affidavit (*20*) Benjamin Madubugwu (Exhibit D), confirming interviews with Mr. Brown Ekwoaba and three others in the identical workplace in November 2015; and public data confirming Mr. Brown Ekwoaba as Assistant Director, Directorate (Investigations) (2015–2020), later State Director (Edo & Kwara).
“That MR. BBB, on web page 202 (*20*) the Licensed True Copy (*20*) proceedings, beneath oath, said as follows: ‘I’ve not met him earlier than besides on this courtroom,’ regardless of earlier testifying (pages 184–188) that he led the seventeenth July 2021 video interview (*20*) the complainant at DSS Headquarters.
“That each witnesses had been shielded behind masks and screens by order (*20*) the trial courtroom, but gave materially false testimony to hide the true chain (*20*) custody (*20*) the 2015 and 2021 statements.”
